Whilst many sites in the UK may be near water, Badwell is relatively unique as the verandas are out over the water.

Terms and Conditions

Contract
The Contract for a short-term holiday rental shall be made between the Client and Badwell Ash Holiday Lodges (BAHL). The contract shall be governed by UK Law. It will be entered into when the deposit is processed and Badwell Ash Holiday Lodges issues the confirmation letter. By making a reservation you are deemed to have accepted our terms and conditions. The Contract will be subject to the following booking conditions.

Booking
The Client making the booking agrees that they are authorised to make this booking on behalf of all persons who shall be renting the property and agrees to take full responsibility for the property and the payment of any rental fees or damages. All persons must be over 18 years old unless the Client is booking all 4 lodges.

Deposit
A deposit of 25% of the rental fee is payable if the booking is made more than eight weeks before the commencement of the rental. Non-payment of the balance of the rental on or before the due date shall be construed as a cancellation of the contract by the Client. For bookings made less than eight weeks before the commencement of the rental, the total rental fee is payable at the time of booking.

Payment
Payments can be made by cheque, credit card or debit card. All cheques must be made payable to Badwell Ash Holiday Lodges and can only be accepted if received not less than two weeks before the commencement of the rental. Credit card payments will be subject to a 2.5% handling charge. No charge will be made for payments by debit card (except for non-UK debit cards).

Cancellations
Any cancellation made by the Client for whatever reason must be in writing. Once the booking has been confirmed the deposit becomes non-refundable. For cancellations made 6-8 week prior to the arrival date, 50% of the total rental fee will be payable, for cancellations made 4-6 weeks prior to the arrival date, 70% of the total rental fee will be payable, for cancellations made less than 4 weeks prior to the arrival date 100% of the total rental fee will be payable. Badwell Ash Holiday Lodges strongly recommends that the Client takes out insurance against cancellation.

Period of Hire
The prices quoted are per lodge, per week or short break on a self-catering basis. Weekly rates apply from Friday at 3.00pm to the following Friday at 10.00am or Monday at 3.00pm to the following Monday at 10.00am. Short breaks are for 4 days midweek starting on Monday at 3.00pm to the following Friday at 10.00am or weekend starting on Friday at 3.00pm to the following Monday at 10.00am. Periods of longer than a week can be booked if arriving and departing on a Monday or Friday.

Advertised Facilities.
Not all items, equipment and facilities advertised may be available at all times due to breakdown, malfunction, or other reasons. The management of BAHL will try to rectify any malfunctions as soon as possible but no refund of any or all of the money paid by the customer will be made.

Occupation of the Lodges
The number of persons occupying the property must not exceed the maximum number of four adults; see also section headed "Children." Badwell Ash Holiday Lodges reserve the right to refuse entry to the entire party if this condition is not observed.

Services
Rental charges include bed linen, towels and bathrobes for use during your stay. Beds will be made up prior to your arrival and for bookings of more than one week linen and towels will be changed at the end of each week. Electricity and water are included within the rental charge.

Care of the Property
The Client shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as was found at the beginning. Apart from if provided by BAHL in the lounge area; no candles are to be used in the lodges or in and around the hot tubs.

Fixtures & Fittings
All fixtures, fittings and equipment must be used solely for their intended purpose. Badwell Ash Holiday Lodges request that you do not take into the lodges any portable heaters, lighting equipment or any items that may cause danger to the lodges, its equipment or its occupants. Any bulky items such as bicycles, fishing or golf equipment are not to be taken into the lodges; outside storage is provided.

Breakages, Damage or Missing Items
The Client is legally bound to reimburse Badwell Ash Holiday Lodges for breakages, damage, missing items or excessive cleaning caused by the party during the period of the rental.

Complaints
Badwell Ash Holiday Lodges endeavour to ensure that everything is to your satisfaction during your stay. Should there be any cause for complaint during the occupation of the property, it must be notified promptly to the management and in the case of a serious problem confirmed in writing.

Smoking
Following Government legislation Badwell Ash Holiday Lodges operates a no smoking policy within the lodges.

Children
Badwell Ash Holiday Lodges is designated as an adult only site. Children may be accepted if a guest books all 4 lodges.

Visitors
Only those persons notified to are entitled to occupy the accommodation allocated. If you receive visitors during your stay who are not resident at Badwell Ash Holiday Lodges you must inform the management. You will be held responsible for the behaviour of your visitors while they are on the site.

Pets
Badwell Ash Holiday Lodges operates a no pet's policy.

Late Arrivals
We ask that you inform us of your planned arrival time. You must inform BAHL if your arrival time changes substantially. If you are liable to arrive after 9.00pm you must make arrangements in advance with the Management for access to your lodge.

Parking
Parking of vehicles must be in the designated car parking area at the front of the site. Planning Permission only allows vehicular access to the lodges apart from loading and unloading on arrival and departure. Your vehicles, their accessories and contents are left entirely at your risk. Badwell Ash Holiday Lodges will not be responsible for any loss or damage from or to any vehicle. If any of your group had mobility problems please discuss this with Management prior to booking.

Liability
Badwell Ash Holiday Lodges cannot accept liability for any damage; expense, injury, death or loss of any nature whatsoever suffered by any person(s) from any cause other than the proven negligence of us or our employees. You must take all necessary steps to safeguard your personal property and no liability to you is accepted in respect of damage to or loss of such property.

Force Majeure
Badwell Ash Holiday Lodges cannot accept responsibility or pay compensation where the performance of our contract with you is prevented or affected by reason of circumstances which amount to force majeure. These circumstances include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of your accommodation (which cannot reasonably be remedied to a satisfactory standard before the start of your holiday) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage, riots or civil strife, natural or nuclear disaster, war or threat of war, actual or threatened terrorist activity and all similar situations beyond our control.

Right of Entry
We will not normally enter a lodge once let without your agreement however employees of BAHL shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

Lost Property
A minimum charge of £10 is made for the return of lost property after your departure. Items of lost property can only be held for a maximum of one month after which time they are donated to charity. We cannot be held responsible for items reported lost which cannot be found. Property is at all times the responsibility of the owner.

Privacy
Protecting your privacy is important to us and we will strive to keep your personal information confidential. Your details will be kept on our database to enable us to keep you up to date with any future offers, information or mailings. We do not give any information to third parties or use information gathered in any other way than those described above. If required by law or legal process to disclose your personal information we will do only in accordance with the law.

Terms and Conditions
Badwell Ash Holiday Lodges reserve the right to change or amend these terms and conditions at any time.
